AN ACT CONCERNING THE INSTALLATION OF SPEED DETECTING CAMERAS ON HIGHWAYS.

Be it enacted by the Senate and House of Representatives in General Assembly convened:

Section 1. (NEW) (Effective October 1, 2010) (a) For the purposes of this section, "automated speed enforcement device" means a device that (1) is designed to automatically record the image of the license plate of a motor vehicle that is traveling at a speed in excess of the speed limit established for a street, road, highway or parking area, and (2) indicates on the recorded image produced the date, time, location of the violation and the speed of the motor vehicle.

(b) The Department of Transportation, in consultation with the Department of Public Safety, may install automated speed enforcement devices on state highways to identify motor vehicles violating section 14-218a or 14-219 of the general statutes.

(c) Whenever a violation of section 14-218a or 14-219 of the general statutes is detected and recorded by an automated speed enforcement device, a sworn police officer shall review the recorded image. If, after such review, such officer finds probable cause that a violation of section 14-218a or 14-219 of the general statutes has occurred, the officer shall issue an infractions complaint ticket or motor vehicle summons ticket, as the case may be, to the registered owner of such motor vehicle and shall, not later than five days after the alleged violation, mail such ticket to such registered owner together with a copy of the recorded image or images produced by the device.

This act shall take effect as follows and shall amend the following sections:
