An act to add Section 38530.5 to the Health and Safety Code, relating to greenhouse gases.

AB 2331, as introduced, Muratsuchi. Greenhouse gases: aviation sector: reporting.
The California Global Warming Solutions Act of 2006 designates the State Air Resources Board as the state agency charged with monitoring and regulating sources of emissions of greenhouse gases. The act requires the state board to consult with other states, the federal government, and other nations to identify the most effective strategies and methods to reduce greenhouse gases, manage greenhouse gas control programs, and facilitate the development of integrated and cost-effective regional, national, and international greenhouse gas reduction programs. The act requires the state board to adopt regulations to require the reporting and verification of statewide greenhouse gas emissions.
This bill would require the state board to adopt regulations to require the reporting of emissions of greenhouse gases from the aviation sector, as provided. The bill would require the state board to include in the greenhouse gases inventory the emissions of greenhouse gases from the aviation sector. The bill would require the state board, by July 1, 2022, to submit recommendations to the appropriate policy committees of the Legislature on actions the state board could take to achieve reductions in the emissions of greenhouse gases in the aviation sector.

The people of the State of California do enact as follows:


SECTION 1.

 Section 38530.5 is added to the Health and Safety Code, to read:

38530.5.
 (a) The state board shall adopt regulations that, to the extent allowable under federal law, require the reporting of emissions of greenhouse gases from commercial passenger, freight, and private aviation sources, including international and interstate aircraft flights originating from, or terminating in, the state. For international or interstate flights, the state board shall develop methodologies to attribute the portion of the emissions that occur within the state.
(b) The state board shall include in the greenhouse gases inventory the emissions of greenhouse gases produced from aviation sources within the state.
(c) (1) By July 1, 2022, the state board shall submit recommendations to the appropriate policy committees of the Legislature on actions the state board could take to achieve reductions in the emissions of greenhouse gases in the aviation sector.
(2) Pursuant to Section 10231.5 of the Government Code, this subdivision becomes inoperative on July 1, 2026.
