AN ACT

 

amending title 41, chapter 6, article 7.2, Arizona Revised Statutes, by adding section 41-1080.01; relating to food service workers.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 41, chapter 6, article 7.2, Arizona Revised Statutes, is amended by adding section 41-1080.01, to read:

START_STATUTE41-1080.01.  Food service workers; authorized presence; documentation; definition

A.  A county shall not issue to an individual a food service worker card if the individual does not provide documentation of citizenship or alien status by presenting to the county any of the documents prescribed in section 41-1080 that indicate that the individual's presence in the United States is authorized under federal law.

B.  If an individual has affirmatively established citizenship of the United States or a form of nonexpiring work authorization issued by the federal government pursuant to subsection A, the individual is not required to provide subsequent documentation of that status on renewal of the food service worker card.

C.  If, on renewal of the food service worker card, an individual holds a limited form of work authorization issued by the federal government that has expired, the individual shall provide documentation of that status.

D.  For the purposes of this section, "food service worker card" means a document issued by a county that certifies that an individual meets the requirements to handle, prepare, serve, sell or give away food for consumption by persons other than the individual's immediate family, or to handle utensils and equipment appurtenant to these activities.
