A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new section, designated §25-1-9, relating to venue for civil and criminal actions arising from or committed on the property comprising the Salem Correctional Center.
Be it enacted by the Legislature of West Virginia:
That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section, designated §25-1-9, to read as follows:
ARTICLE 1. ORGANIZATION, INSTITUTIONS AND CORRECTIONS MANAGEMENT.
§25-1-9. Venue for Salem Correctional Center.
(a) Notwithstanding any other provision of this code to the contrary, venue for any civil action arising on the grounds of the Salem Correctional Center established in the article shall be in Harrison County.
(b) Except as provided by the provisions of sections eleven and twelve, article eleven, chapter sixty-one of this code, venue for any criminal offense committed on the grounds of the Salem Correctional Center lies in the county in which the offense was committed.
