AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee for Courts of Justice
on March 2, 2022)
(Patrons Prior to Substitute--Senators Surovell and Lucas [SB 518])
A BILL to direct the Department of Criminal Justice Services to make recommendations on the resentencing of persons convicted of marijuana-related offenses.

Be it enacted by the General Assembly of Virginia:

1. §1. That the Department of Criminal Justice Services shall make recommendations regarding the resentencing of persons convicted of marijuana-related offenses committed prior to July 1, 2021, who remain incarcerated for such conviction or a combination of such convictions or remain on community supervision for such conviction or a combination of such convictions. The Department of Criminal Justice Services shall submit to the Governor and the General Assembly a report of its recommendations by November 1, 2022. The report shall be submitted as provided in the procedures of the Division of Legislative Automated Systems for the processing of legislative documents and shall be posted on the General Assembly's website.
