A BILL to amend and reenact § 2.2-613 of the Code of Virginia, relating to state agency mandates on localities.

Be it enacted by the General Assembly of Virginia:

1.  That § 2.2-613 of the Code of Virginia is amended and reenacted as follows:

§ 2.2-613. Agency mandates on localities; assessment.

Pursuant to § 15.2-2903, all agencies, as defined in § 2.2-128, shall conduct an assessment of all mandates imposed on local governments administered by the agency to determine which mandates, if any, may be altered or eliminated.  [ Such assessment shall include a detailed cost-benefit analysis and utilization of performance-based metrics to determine the value of the mandate in relation to the required or intended output or desired result. With respect to state mandates imposed on local governments, such assessments shall include an estimate of the fiscal impact of the mandates on the affected local governments in addition to a written justification as to why the mandate should or should not be eliminated.  ]
