AMENDMENT IN THE NATURE OF A SUBSTITUTE
(Proposed by the House Committee on Health and Human Services
on February 6, 2024)

A BILL to direct the Department of Medical Assistance Services to amend its regulations to provide flexibility in waiver usage for local community services boards.

Be it enacted by the General Assembly of Virginia:

1. §1. That the Department of Medical Assistance Services shall amend its regulations to grant the Department of Behavioral Health and Developmental Services (DBHDS) the authority to reallocate unused Community Living waiver slots, Family and Individual Support waiver slots, and Building Independence waiver slots among community services boards or regions, whichever is applicable. DBHDS may reallocate a waiver slot only if such waiver slot is unused for a period of at least 30 days and no individual on the Priority One waitlist, as described in 12VAC30-122-90, is identified within the catchment area of the applicable community services board or applicable region during such 30-day period.
