relating to the satisfaction of a condition of community | ||
supervision requiring performance of community service. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 16(f), Article 42.12, Code of Criminal | ||
Procedure, is amended to read as follows: | ||
(f) In lieu of requiring a defendant to work a specified | ||
number of hours at a community service project or projects under | ||
Subsection (a), the judge may order a defendant to make a specified | ||
donation to: | ||
(1) a nonprofit food bank or food pantry in the | ||
community in which the defendant resides; or | ||
(2) an organization selected by the defendant that is | ||
tax-exempt under Section 501(c)(3), Internal Revenue Code of 1986, | ||
and is approved by the judge. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2013. |
