A BILL TO BE ENTITLED
 
AN ACT
  relating to the notice of intent to obtain a permit from the Texas
  Commission on Environmental Quality.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 5.552, Water Code, is amended by
  amending Subsection (d) and adding Subsection (d-1) to read as
  follows:
         (d)  In addition to providing notice under Subsection
  (b)(1), the applicant shall, not later than the 30th day after the
  date the commission determines the application to be
  administratively complete:
               (1)  at the site of the facility or proposed facility,
  place a sign stating:
                     (A)  that an application for a permit for a
  facility at the site has been filed;
                     (B)  the name of and contact information for the
  applicant;
                     (C)  the proposed site use; and
                     (D)  the manner in which the applicant may be
  contacted for further information; and
               (2)  comply with any applicable public notice
  requirements under Chapters 26 and 27 of this code, Chapter 361,
  Health and Safety Code, and rules adopted under those chapters.
         (d-1)  The sign required by Subsection (d) must:
               (1)  have dimensions not smaller than 18 inches by 28
  inches;
               (2)  consist of dark letters on a white background; and
               (3)  consist of lettering:
                     (A)  at least 1.5 inches in height; and
                     (B)  in block capital letters.
         SECTION 2.  The changes in law made by this Act apply only to
  an application that is filed with the Texas Commission on
  Environmental Quality on or after the effective date of this Act.
  An application filed before the effective date of this Act is
  governed by the law in effect on the date of filing, and that law is
  continued in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2023.
