relating to restrictions on the use of commercial social networking | ||
sites by sex offenders; imposing a criminal penalty. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 62, Code of Criminal Procedure, is | ||
amended by adding Article 62.0552 to read as follows: | ||
Art. 62.0552. USE OF COMMERCIAL SOCIAL NETWORKING SITES BY | ||
CERTAIN OFFENDERS. (a) In this article, "commercial social | ||
networking site" has the meaning assigned by Article 62.0061(f). | ||
(b) A person required to register under this chapter who | ||
uses a commercial social networking site and is not otherwise | ||
prohibited from accessing the site under Section 13G, Article | ||
42.12, shall include the following information in the person's | ||
profile for the site and shall ensure the information is viewable by | ||
all visitors of the site: | ||
(1) an indication that the person is a sex offender; | ||
(2) the type of offense for which the person is subject | ||
to registration under this chapter and the city and county in which | ||
the person was convicted of or placed on deferred adjudication for | ||
that offense; | ||
(3) the person's full name, date of birth, sex, race, | ||
height, weight, eye color, and hair color; and | ||
(4) the address at which the person resides or intends | ||
to reside or, if the person does not reside or intend to reside at a | ||
physical address, a detailed description of each geographical | ||
location at which the person resides or intends to reside. | ||
SECTION 2. The change in law made by this Act in amending | ||
Chapter 62, Code of Criminal Procedure, applies to any person who, | ||
on or after the effective date of this Act, is subject to | ||
registration under that chapter, regardless of whether the offense | ||
for which the person is subject to registration was committed | ||
before, on, or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2013. |
