relating to requiring a court that sets an execution date to | ||
withdraw the execution date on the motion of the prosecuting | ||
attorney with jurisdiction over the underlying case. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Article 43.141, Code of Criminal Procedure, is | ||
amended by adding Subsection (d-1) to read as follows: | ||
(d-1) The convicting court shall withdraw the order of the | ||
court setting a date for execution in a death penalty case on the | ||
motion of the attorney representing the state. | ||
SECTION 2. This Act takes effect September 1, 2023. |
