A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring a court that sets an execution date to
  withdraw the execution date on the motion of the prosecuting
  attorney with jurisdiction over the underlying case.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Article 43.141, Code of Criminal Procedure, is
  amended by adding Subsection (d-1) to read as follows:
         (d-1)  The convicting court shall withdraw the order of the
  court setting a date for execution in a death penalty case on the
  motion of the attorney representing the state.
         SECTION 2.  This Act takes effect September 1, 2023.
