A BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-3455 SO AS TO PROVIDE THAT A BICYCLIST MAY OPERATE A BICYCLE ON A SIDEWALK WHERE ONE IS AVAILABLE AND DOES NOT HAVE ACCESS TO A BICYCLE PATH OR LANE, TO PROVIDE THAT WHEN OPERATING A BICYCLE ON A SIDEWALK, THE BICYCLIST MUST YIELD TO PEDESTRIANS AND TO PROVIDE THAT THIS SECTION DOES NOT APPLY TO TOWNS AND MUNICIPALITIES LOCATED ALONG A BEACHFRONT OR IN HIGH-TOURIST AREAS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 27, Chapter 5, Title 56 of the 1976 Code is amended by adding:
"Section 56-5-3455. (A) A bicyclist may operate a bicycle on a sidewalk where one is available and does not have access to a bicycle path or lane.
(B) When operating a bicycle on a sidewalk, the bicyclist must yield to pedestrians.
(C) This section does not apply to sidewalks located in towns and municipalities located along a beachfront or high-tourist areas."
SECTION 2. This act takes effect upon approval by the Governor.
