| AN ACT |
| |
1 | Providing for the acquisition and operation of the Horsham Joint |
2 | Interagency Installation and limitation on use of |
3 | installation. |
4 | The General Assembly of the Commonwealth of Pennsylvania |
5 | hereby enacts as follows: |
6 | Section 1. Horsham Joint Interagency Installation. |
7 | (a) General rule.--The Commonwealth is authorized to acquire |
8 | from the United States, by conveyance, lease, license or other |
9 | means, all available lands, easements, Air Installation |
10 | Compatible Use Zones and facilities at the Willow Grove Naval |
11 | Air Station Joint Reserve Base and the Willow Grove Air Reserve |
12 | Station for operation as a joint interagency installation for |
13 | use by the Pennsylvania National Guard and other Department of |
14 | Defense components, Federal, State and local government agencies |
15 | and associated users to perform national defense, homeland |
16 | security and emergency preparedness missions. The property so |
17 | acquired shall be known as the Horsham Joint Interagency |
18 | Installation. |

1 | (b) Associated users.--Without regard to the ownership of |
2 | the land, associated users of the installation shall pay local |
3 | taxes, including real property taxes, and shall comply with |
4 | local land use ordinances and regulations, including, but not |
5 | limited to, the local zoning ordinance, subdivision and land |
6 | development ordinance, local impact fees and, to the extent |
7 | required by law, the Uniform Construction Code as adopted by |
8 | Horsham Township. |
9 | (c) Restrictions on installation use and occupancy.--The |
10 | installation shall be occupied or used only by governmental |
11 | agencies, military units and nongovernmental associated users |
12 | performing the missions of national defense, emergency |
13 | preparedness and homeland security. The installation shall not |
14 | be used for any of the following purposes: |
15 | (1) Commercial passenger operations. |
16 | (2) Commercial cargo operations. |
17 | (3) Commercial, business or nongovernmental aircraft |
18 | operations, except for flights undertaken in response to |
19 | exigent circumstances. |
20 | (4) As a reliever airport, to relieve congestion at |
21 | other airports or to provide improved aviation access to the |
22 | overall region, except that this paragraph shall not apply in |
23 | exigent circumstances. |
24 | (d) Limitation on statutory construction.--Authorized | <-- |
25 | associated user.--An authorized associated user of the |
26 | installation and airfield described in this act shall include a |
27 | nonprofit entity that operates a historical aviation museum. |
28 | (e) Construction.-- |
29 | (1) Nothing under this section shall be construed to |
30 | diminish or alter authorized uses of the installation, |

1 | including any military enclave located thereon, by the United |
2 | States, its agencies or instrumentalities or to limit use of |
3 | the property in exigent circumstances. |
4 | (2) Documents that convey, lease or license the |
5 | installation to the Commonwealth shall include language |
6 | providing that the restrictions on installation use specified |
7 | under subsection (c) shall be a binding covenant and |
8 | restriction that shall run with the land for which this |
9 | Commonwealth, Horsham Township and the Hatboro Horsham School |
10 | District shall be third party beneficiaries. |
11 | (e) (f) Definitions.--The following words and phrases when | <-- |
12 | used in this section shall have the meanings given to them in |
13 | this subsection unless the context clearly indicates otherwise: |
14 | "Airfield." The Pitcairn-Willow Grove Field at the | <-- |
15 | installation. |
16 | "Associated users." Nongovernmental organizations and |
17 | private entities performing the national defense, homeland |
18 | security or emergency preparedness missions of the installation |
19 | that are tenants of the installation under lease, license or |
20 | other similar access or use agreements. |
21 | "Commercial cargo operations." Aircraft operations by a |
22 | nongovernmental cargo or freight carrier, in any case in which |
23 | cargo is delivered to or flown from the installation. |
24 | "Commercial passenger operations." Aircraft passenger |
25 | operations by nongovernmental passenger carriers involving |
26 | flights where passengers are boarded or deplaned at the |
27 | installation. |
28 | "Exigent circumstances." Any of the following limited- |
29 | duration events: Adverse or unusual weather conditions, alerts |
30 | and actual or threatened emergencies that are a danger to human |

2 | "Installation." The Horsham Joint Interagency Installation |
3 | referred to under subsection (a). |
4 | Section 2. Effective date. |
5 | This act shall take effect immediately. |
