AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," in charter schools, prohibiting the

6

consumption, sale or purchase of alcohol in any facility used

7

for charter school or cyber charter school purposes; and

8

providing for penalties.

The General Assembly of the Commonwealth of Pennsylvania

10

hereby enacts as follows:

Section 1.  Section 1722-A of the act of March 10, 1949

12

(P.L.30, No.14), known as the Public School Code of 1949, is

13

amended by adding a subsection to read:

14

Section 1722-A.  Facilities.--* * *

15

(b.1)  (1)  Alcoholic beverages shall not be available for

16

consumption, purchase or sale in any charter school facility or

17

cyber charter school facility.

(2)  If the secretary reasonably believes that alcoholic

19

beverages have been made available for consumption, purchase or

20

sale in any charter school facility or cyber charter school

facility, the department shall order the following forfeitures

2

against the charter school or cyber charter school:

3

(i)  Five thousand dollars ($5,000) for the first violation.

4

(ii)  Ten thousand dollars ($10,000) for the second or

5

subsequent violation.

The department shall deduct the amount of the forfeiture from

7

any and all payments from the State Treasury to the charter

8

school or cyber charter school.

9

(3)  The charter school or cyber charter school may appeal

10

the order of the secretary pursuant to 2 Pa.C.S. Chs. 5

11

(relating to practice and procedure) and 7 (relating to judicial

12

review).

13

Section 2.  This act shall take effect immediately.
