| AN ACT |
| |
1 | Amending Title 18 (Crimes and Offenses) of the Pennsylvania |
2 | Consolidated Statutes, in trade and commerce, further |
3 | providing for the offense of trading in motor vehicles and |
4 | trailers. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Section 7365 of Title 18 of the Pennsylvania |
8 | Consolidated Statutes is amended to read: |
9 | § 7365. [Trading in motor vehicles and trailers.] Sunday |
10 | trading. |
11 | (a) Offense defined.--A person is guilty of a summary |
12 | offense if he engages in the business of buying, selling, |
13 | exchanging, trading, or otherwise dealing in new or used motor |
14 | vehicles or trailers, on Sunday. |
15 | (a.1) Applicability.--This section does not apply to the |
16 | buying, selling, exchanging, trading or otherwise dealing in new |
17 | or used motorcycles. |

1 | (b) Repeated offense penalty.--A person who commits a second |
2 | or any subsequent offense within one year after conviction for |
3 | the first offense, shall be sentenced to pay a fine not |
4 | exceeding $200. |
5 | (c) Definitions.--As used in this section the following |
6 | words and phrases shall have the meanings given to them in this |
7 | subsection: |
8 | ["Motor vehicle." Every self-propelled device in, upon or by |
9 | which any person or property is or may be transported or drawn |
10 | on a public highway.] |
11 | "Motorcycle." A motor vehicle having a seat or saddle for |
12 | the use of the rider and is designed to travel on not more than |
13 | three wheels in contact with the ground. |
14 | "Trailer." Every vehicle, without motor power, designed to |
15 | carry property or passengers or designed and used exclusively |
16 | for living quarters wholly on its own structure, and to be drawn |
17 | by a motor vehicle. |
18 | Section 2. This act shall take effect in 60 days. |
