A BILL
To amend section 3301.01 of the Revised Code to 1
establish state board of education districts based 2
on the 2011 plan of apportionment.3


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF OHIO:

       Section 1. That section 3301.01 of the Revised Code be 4
amended to read as follows:5

       Sec. 3301.01.  (A) There is hereby created the state board of 6
education consisting of nineteen members with eleven elected 7
members, one each to be elected in accordance with section 3301.03 8
of the Revised Code from each of the districts established in 9
accordance with division (B) of this section, and with eight 10
members to be appointed by the governor with the advice and 11
consent of the senate.12

       In addition to the nineteen elected or appointed members, the 13
chairperson of the committee of the senate that primarily deals 14
with education and the chairperson of the committee of the house 15
of representatives that primarily deals with education shall be 16
nonvoting ex officio members of the board.17

       (B)(1) The territory of each state board of education 18
district for each elected voting member of the board shall consist 19
of the territory of three contiguous senate districts as 20
established in the most recent apportionment for members of the 21
general assembly, but the territory of no senate district shall be 22
part of the territory of more than one state board of education 23
district. Each state board of education district shall be as 24
compact as practicable. The districts shall include, when 25
practicable, some districts that primarily consist of territory in 26
rural areas and some districts that primarily consist of territory 27
in urban areas.28

       (2) If, after the apportionment for members of the general 29
assembly is made in any year, the general assembly does not during 30
that year enact legislation establishing state board of education 31
districts in accordance with division (B)(1) of this section, the 32
governor shall designate the boundaries of the districts in 33
accordance with division (B)(1) of this section no later than the 34
thirty-first day of January of the year next succeeding such 35
apportionment. Upon making such designation, the governor shall 36
give written notice of the boundaries of the districts to each 37
member of the state board of education, including the nonvoting ex 38
officio members; the superintendent of public instruction; the 39
president of the senate; the speaker of the house of 40
representatives; and the board of elections of each county in each 41
new district. On the first day of February in any year in which 42
the governor designates the boundaries of state board of education 43
districts under this section, the state board of education 44
districts as they existed prior to that date shall cease to exist 45
and the new districts shall be created.46

       (C)(1) For the purpose of election of members of the state 47
board of education, the state is divided into the following 48
districts: 49

       (a) The first district contains senate districts one, two, 50
and eleven.51

       (b) The second district contains senate districts ten, 52
twelve, and twenty-six.53

       (c) The third district contains senate districts four, five, 54
and six.55

       (d) The fourth district contains senate districts seven, 56
eight, and nine.57

       (e) The fifth district contains senate districts fourteen, 58
seventeen, and thirty.59

       (f) The sixth district contains senate districts three, 60
fifteen, and sixteen.61

       (g) The seventh district contains senate districts nineteen, 62
twenty, and thirty-one.63

       (h) The eighth district contains senate districts 64
twenty-seven, twenty-eight, and twenty-nine.65

       (i) The ninth district contains senate districts eighteen, 66
thirty-two, and thirty-three.67

       (j) The tenth district contains senate districts thirteen, 68
twenty-two, and twenty-four.69

       (k) The eleventh district contains senate districts 70
twenty-one, twenty-three, and twenty-five.71

       (2) The senate districts referenced in division (C)(1) of 72
this section are the senate districts described in the final Ohio 73
apportionment plan as amended, adopted, and engrossed on September 74
30, 2011, by the persons responsible for apportionment. 75

       Section 2. That existing section 3301.01 of the Revised Code 76
is hereby repealed.77
