A CONCURRENT RESOLUTION
To urge the Congress of the United States to pass 1
Senate Joint Resolution 26, which proposes to 2
invalidate regulations of the United States 3
Environmental Protection Agency related to 4
greenhouse gases.5


BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF OHIO
(THE SENATE CONCURRING):


       WHEREAS, The Administrator of the United States Environmental 6
Protection Agency has formally issued an endangerment finding in 7
the Federal Register under the federal Clean Air Act regarding six 8
greenhouse gases, including carbon dioxide; and 9

       WHEREAS, The Environmental Protection Agency's efforts to 10
regulate carbon dioxide and other greenhouse gases under the Clean 11
Air Act without Congressional input represents a clear 12
contravention of the principle of separation of powers; and13

       WHEREAS, The regulation of carbon dioxide and other 14
greenhouse gases has serious implications with respect to the 15
economy of the United States and would likely result in slower or 16
negative economic growth, a loss of competitiveness in the global 17
market, and a reduction of the standard of living of the citizens 18
of the United States; and19

       WHEREAS, At a time when the economy is in a fragile period of 20
recovery from the most severe recession since the Great 21
Depression, the unemployment rate exceeds ten per cent, and job 22
growth has been negligible, it would be unwise to embark upon a 23
new regulatory scheme that would create serious economic 24
uncertainty; and25

       WHEREAS, On January 21, 2010, thirty-nine United States 26
Senators of both political parties introduced Senate Joint 27
Resolution 26 pursuant to provisions of the Congressional Review 28
Act, which authorizes Congress to review every new federal 29
regulation issued by federal agencies and, by passage of a joint 30
resolution, overrule a regulation. Senate Joint Resolution 26 31
provides that the Congress of the United States disapproves of the 32
rules of the United States Environmental Protection Agency related 33
to the endangerment finding for greenhouse gases under the Clean 34
Air Act; now therefore be it35

       RESOLVED, That we, the members of the 128th General Assembly 36
of the State of Ohio, in adopting this resolution, strongly urge 37
the Congress of the United States to pass Senate Joint Resolution 38
26; and be it further39

       RESOLVED, That the Clerk of the House of Representatives 40
transmit duly authenticated copies of this resolution to the 41
Speaker and Clerk of the United States House of Representatives, 42
the President Pro Tempore and Secretary of the United States 43
Senate, the members of the Ohio Congressional delegation, and the 44
news media of Ohio.45
