        Introduced  by  Sen.  PARKER -- read twice and ordered printed, and when
          printed to be committed to the Committee on  Energy  and  Telecommuni-
          cations

        AN  ACT  to amend the public service law and the public authorities law,
          in relation to creating a resilient electric vehicle  charging  system
          pilot program

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. The public service law is amended by adding a  new  section
     2  66-x to read as follows:
     3    §  66-x. Resilient electric vehicle charging system pilot program.  1.
     4  For the purposes of this section:
     5    (a) "Resilient carbon free power generation"  shall  mean  only  those
     6  generating stations which are:
     7    (i)  manufactured, installed, and operated in accordance with applica-
     8  ble government and industry standards;
     9    (ii) connected to the electric system and operated in conjunction with
    10  an electric corporation's transmission and distribution system;
    11    (iii) operated in  compliance  with  any  standards  and  requirements
    12  established under this section;
    13    (iv)  utilize  a  synchronous  generator  with black start capability,
    14  frequency control, and disconnect capability; and
    15    (v) do not include the active use of fossil  fuels  and  have  a  name
    16  plate capacity of 1.5 megawatts or less.
    17    (b)  "Resilient  electric vehicle charging system" shall mean an elec-
    18  tric vehicle (EV) microgrid designed to provide  uninterrupted  electric
    19  service for electric vehicle charging throughout an extended outage.
    20    (c)  "Extended  outage"  shall mean an outage of the electric distrib-
    21  ution system that continues for a period of twenty-four hours or longer.
    22    (d) "Uninterrupted" shall mean that  the  resilient  electric  vehicle
    23  charging  system  generates  electricity  throughout an extended outage,
    24  with the exception of momentary interruptions  associated  with  transi-
    25  tions to and from grid parallel and grid-islanded operations.

     1    (e)  "EV  microgrid" is a group of energy generating resources with at
     2  least one source of resilient carbon free power  generation  and  energy
     3  storage  within  clearly  defined  electrical  boundaries that acts as a
     4  single controllable entity with respect to the grid for the  purpose  of
     5  electric  vehicle  charging and other emergency response needs during an
     6  extended outage. An EV microgrid can connect  and  disconnect  from  the
     7  grid to enable it to operate in both grid-connected or island-mode.
     8    2.  The commissioner shall promulgate such rules, policies, and proce-
     9  dures necessary and appropriate no later than one  hundred  eighty  days
    10  following the effective date of this section for:
    11    (a)  creating  a  resilient  electric  vehicle  charging  system pilot
    12  program at the commercial retail rate with a  monthly  cash  out  option
    13  program and a total program cap of 50 megawatts;
    14    (b)  establishing  a  value stack adder for valuation of uninterrupted
    15  resilient carbon free power generation generated within an EV  microgrid
    16  that  is  participating  in  the pilot program that supports a resilient
    17  electric vehicle charging system at the commercial retail rate; and
    18    (c) creating a timely interconnection  process  for  resilient  carbon
    19  free power generation comprising an EV microgrid.
    20    § 2. Section 1005 of the public authorities law is amended by adding a
    21  new subdivision 31 to read as follows:
    22    31.  The  authority in a manner consistent with section sixty-six-x of
    23  the public service law,  shall  promulgate  such  rules,  policies,  and
    24  procedures  necessary  and  appropriate no later than one hundred eighty
    25  days following the effective date of this subdivision for:
    26    (a) creating a resilient  electric  vehicle  charging  system  at  the
    27  commercial  retail  rate  with  a  monthly cash out option program and a
    28  total program cap of 50 megawatts;
    29    (b) establishing a value stack adder for  valuation  of  uninterrupted
    30  resilient  carbon free power generation generated within an EV microgrid
    31  that is also a participant of the pilot program that supports  a  resil-
    32  ient electric vehicle charging system at the commercial retail rate; and
    33    (c)  creating  a  timely  interconnection process for resilient carbon
    34  free power generation comprising an EV microgrid.
    35    § 3. Section 1020-f of the public authorities law, as added by chapter
    36  517 of the laws of 1986, is amended by adding a new subdivision (ll)  to
    37  read as follows:
    38    (ll)  The authority in a manner consistent with section sixty-six-x of
    39  the public service law,  shall  promulgate  such  rules,  policies,  and
    40  procedures  necessary  and  appropriate no later than one hundred eighty
    41  days following the effective date of this section for:
    42    1. creating a  resilient  electric  vehicle  charging  system  at  the
    43  commercial  retail  rate  with a monthly cash out option program and the
    44  total program cap of 50 megawatts;
    45    2. establishing a value stack adder  for  valuation  of  uninterrupted
    46  resilient  carbon free power generation generated within an EV microgrid
    47  that is also a participant of the pilot program that supports  a  resil-
    48  ient electric vehicle charging system at the commercial retail rate; and
    49    3. creating a timely interconnection process for resilient carbon free
    50  power generation comprising an EV microgrid.
    51    § 4. This act shall take effect immediately.
