MARTINEZ -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to authorizing the Village of Patchogue to file an application for exemption from real property taxes for certain assess- ment rolls The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other provision of law to the contrary, 2 the assessor of the Town of Brookhaven, County of Suffolk, is hereby 3 authorized to accept from the Village of Patchogue, a municipal corpo- 4 ration, an application for exemption from real property taxes pursuant 5 to section 420-a of the real property tax law with respect to the 6 parcels previously owned by the Housing Trust Fund Corporation (HTFC) 7 with such parcels being located in the Village of Patchogue at: 8 (i) 41 Smith Street, otherwise known as Suffolk County tax map 9 district 0204 section 020.00 block 04.00 lot 004.000; 405 Rider Avenue, 10 Patchogue, otherwise known as Suffolk County tax map district 0204 11 section 020.00 block 04.00 lot 030.00; 390 Rider Avenue, Patchogue, 12 otherwise known as Suffolk County tax map district 0204 section 020.00 13 block 03.00 lot 034.001 and 44 Maiden Lane, Patchogue, otherwise known 14 as Suffolk County tax map district 0204 section 019.00 block 09.00 lot 15 001.000 for the 2017-2018 tax assessment roll; and 16 (ii) 28 Smith Street, otherwise known as Suffolk County tax map 17 district 0204 section 020.00 block 05.00 lot 008.000; 18 Smith Street, 18 otherwise known as Suffolk County tax map district 0204 section 020.00 19 block 05.00 lot 003.000 and 20 Smith Street, otherwise known as Suffolk 20 County tax map district 0204 section 020.00 block 05.00 lot 004.000 for 21 the 2017-2018 and 2018-2019 tax assessment rolls. 22 If satisfied that such municipal corporation should not be liable for 23 such outstanding property taxes on the aforementioned properties, the 24 assessor, upon the approval of the Town of Brookhaven town board, may EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15534-03-0S. 7901--B 2 1 grant exemption from taxation on such assessment rolls and make the 2 appropriate corrections of the subject rolls. If exemptions are granted 3 and such municipal corporation, therefore, shall have paid any tax with 4 respect to the subject rolls, the applicable governing body or tax 5 departments, in their sole discretion, shall provide for the refund of 6 the taxes paid, along with any fines or penalties paid, and cancel taxes 7 remaining unpaid. 8 § 2. This act shall take effect immediately.
