       Introduced  by  Sen. MARTINS -- read twice and ordered printed, and when
         printed to be committed to the Committee on Education
       AN ACT to amend the education  law,  in  relation  to  limitations  upon
         school district tax levies
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 2023-a of the education law is amended by adding  a
    2  new subdivision 3-a to read as follows:
    3    3-A.  TAX REFUNDS. WHENEVER THE OBLIGATION TO PAY PROPERTY TAX REFUNDS
    4  FROM CERTIORARI PROCEEDINGS IS TRANSFERRED FROM A LOCAL GOVERNMENT TO  A
    5  SCHOOL DISTRICT LOCATED WITHIN A SPECIAL ASSESSING UNIT AS DEFINED UNDER
    6  ARTICLE  EIGHTEEN  OF  THE  REAL PROPERTY TAX LAW, THE STATE COMPTROLLER
    7  SHALL DETERMINE THE COSTS AND SAVINGS ON THE AFFECTED  LOCAL  GOVERNMENT
    8  AND  SCHOOL  DISTRICT APPLICABLE TO SUCH TRANSFER, AND NOTIFY SUCH LOCAL
    9  GOVERNMENT AND SCHOOL DISTRICT OF SUCH DETERMINATION AND THAT THEY SHALL
   10  ADJUST THEIR TAX LEVY LIMITS ACCORDINGLY.
   11    S 2. This act shall take effect on the thirtieth day  after  it  shall
   12  have  become a law; provided that the amendment to section 2023-a of the
   13  education law made by section one of  this  act  shall  not  affect  the
   14  repeal of such section and shall be deemed repealed therewith.
