        Introduced  by  Sen.  COMRIE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Finance
        AN ACT to amend the executive law, in relation to  outreach  programming
          for  minority  and  women-owned  business  enterprises;  and making an
          appropriation therefor
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  Paragraphs (a) and (c) of subdivision 3 of section 311 of
     2  the executive law, as added by chapter 261 of  the  laws  of  1988,  are
     3  amended to read as follows:
     4    (a)  to  encourage and assist contracting agencies in their efforts to
     5  increase participation by minority and women-owned business  enterprises
     6  on  state  contracts and subcontracts so as to facilitate the award of a
     7  fair share of such contracts to them and to provide  on  the  division's
     8  website  a  list  of  each contracting agency's minority and women-owned
     9  business  enterprises   certification   outreach   seminars,   contacts,
    10  resources, events and opportunities;
    11    (c)  to conduct educational outreach programs to encourage the certif-
    12  ication of minority and women-owned business enterprises, as defined  by
    13  subdivisions  seven  and  fifteen  of  section three hundred ten of this
    14  article, and to promote such program to groups of  minorities,  with  an
    15  emphasis  on  under-represented minorities, consistent with the purposes
    16  of this article[;]. As used in this paragraph, "under-represented minor-
    17  ities"  means  minority  groups  with  a  state  contract  participation
    18  percentage  of less than twenty percent of the total minority and women-
    19  owned business enterprise participation, such as blacks and Hispanics.
    20    § 2. The sum of one million dollars ($1,000,000), or so  much  thereof
    21  as  may be necessary, is hereby appropriated to the division of minority
    22  and women's business development from any moneys in the  state  treasury
    23  in  the  general  fund  to the credit of the state purposes account, not
    24  otherwise appropriated, for the purposes of carrying out the  provisions
    25  of  section  one of this act. Such sum shall be payable on the audit and
    26  warrant of the state comptroller on vouchers certified  or  approved  by
    27  the  division  of minority and women's business development, or its duly

     1  designated representative in the manner provided by law. No  expenditure
     2  shall be made from this appropriation until a certificate of approval of
     3  availability  shall  have  been issued by the director of the budget and
     4  filed  with the state comptroller and a copy filed with the chair of the
     5  senate finance committee and the chair of the assembly  ways  and  means
     6  committee.  Such  certificate  may  be  amended from time to time by the
     7  director of the budget and a copy of each such amendment shall be  filed
     8  with  the  state  comptroller, the chair of the senate finance committee
     9  and the chair of the assembly ways and means committee.
    10    § 3. This act shall take effect immediately; provided,  however,  that
    11  the  amendments  to section 311 of the executive law made by section one
    12  of this act shall not affect the expiration of such section and shall be
    13  deemed to expire therewith.
