STATE OF NEW YORK ________________________________________________________________________ 6816 2019-2020 Regular Sessions IN SENATE October 28, 2019 ___________ Introduced by Sen. RAMOS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the executive law, in relation to defining employees of the state The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 6 of section 292 of the executive law, as 2 amended by chapter 481 of the laws of 2010, is amended to read as 3 follows: 4 6. The term "employee" in this article does not include any individual 5 employed by his or her parents, spouse or child, or in the domestic 6 service of any person except as set forth in section two hundred nine- 7 ty-six-b of this [title] article; provided, however, that for the 8 purposes of this article, the following shall be deemed employees of the 9 state: 10 (a) statewide elected officials, including the governor, lieutenant 11 governor, comptroller, and attorney general; 12 (b) state officers and employees, including: 13 (i) heads of state departments and their deputies and assistants who 14 serve at the discretion of a statewide elected official; and 15 (ii) officers and employees of statewide elected officials who serve 16 at the discretion of the statewide elected official; 17 (c) legislative employees, including officers and employees of the 18 legislature; and 19 (d) legislative members, including senators and members of the assem- 20 bly. 21 § 2.
