STATE OF NEW YORK ________________________________________________________________________ 6785 2019-2020 Regular Sessions IN SENATE October 18, 2019 ___________ Introduced by Sen. BIAGGI -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to requirements for the re-registration for physicians The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 6524 of the education law is amended by adding a 2 new subdivision 12 to read as follows: 3 (12) (a) As used in this section: 4 (i) "Adverse childhood experiences" means stressful or traumatic expe- 5 riences experienced during childhood, which are strongly related to the 6 development and prevalence of a wide range of health problems throughout 7 a person's lifetime, including, but not limited to physical or sexual 8 abuse; domestic violence; parental mental illness; substance abuse; and 9 incarceration. 10 (ii) "Continuing medical education organization" means an accredi- 11 tation council for continuing medical education, a physician specialty 12 organization, or any other appropriate entity, as determined by the 13 commissioner, in consultation with the commissioner of health. 14 (iii) "Physician specialty organization" means the American Board of 15 Medical Specialties; the American Osteopathic Association Bureau of 16 Professional Education; the American Board of Physician Specialties; the 17 Royal College of Physicians of Canada; and any other entity maintaining 18 standards for and certifying physician specialty certification that is 19 approved by the Accreditation Council of Graduate Medical Education, or 20 any other equivalent entity, as determined by the commissioner, in 21 consultation with the commissioner of health. 22 (b) No physician may be re-registered unless he or she, as part of the 23 re-registration application, includes an attestation, in a form 24 prescribed by the commissioner, that he or she has previously completed 25 at least four hours of continuing medical education from a continuing EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01060-01-9S. 6785 2 1 medical education organization on the screening of children for adverse 2 childhood experiences; provided, that the commissioner, in consultation 3 with the commissioner of health, shall provide for an exemption process 4 based on the nature of the physician's practice. 5 § 2. This act shall take effect on the one hundred eightieth day after 6 it shall have become a law. Effective immediately, the addition, amend- 7 ment and/or repeal of any rule or regulation necessary for the implemen- 8 tation of this act on its effective date are authorized to be made and 9 completed by the commissioner of education on or before such date.
