THIELE -- read once and referred to the Committee on Local Governments AN ACT authorizing the alienation of certain parklands in the town of East Hampton, county of Suffolk The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subject to the provisions of this act, the town of East 2 Hampton, in the county of Suffolk, acting by and through its governing 3 body and upon such terms and conditions as determined by such body, is 4 hereby authorized to discontinue as parklands and alienate the lands 5 more particularly described in section three of this act for the purpose 6 of establishing a hospital emergency room. 7 § 2. The authorization contained in section one of this act shall be 8 effective only upon the condition that the town of East Hampton dedicate 9 an amount equal to or greater than the fair market value of the park- 10 lands being discontinued towards the acquisition of new parklands and/or 11 capital improvements to existing parkland and recreational facilities. 12 § 3. The parklands authorized by section one of this act to be alien- 13 ated are described as follows: 14 ALL that certain plot, piece or parcel of land, with buildings and 15 improvements thereon erected, situate, lying and being in the Town of 16 East Hampton, County of Suffolk and State of New York, more particularly 17 bounded and described as follows: 18 BEGINNING at a point on the easterly side of Pantigo Place, as shown 19 on Map of Pospisil Associates, said point being distant 638.68 feet 20 northerly, as measured along the easterly side of Pantigo Place from the 21 northerly side of Montauk Highway, Route 27; EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13092-01-9S. 6291 2 A. 8100 1 RUNNING THENCE from the point of beginning along Pantigo Place, north- 2 erly and westerly along the arc of a circular curve having a radius of 3 60.00 feet, and turning to the left a distance of 153.16 feet; 4 RUNNING THENCE North 8 degrees 29 minutes 58 seconds West, 174.57 5 feet; 6 RUNNING THENCE South 86 degrees 42 minutes 40 seconds West, 260.00 7 feet; 8 RUNNING THENCE along the land now or formerly Town of East Hampton 9 North 3 degrees 17 minutes 20 seconds West, 230.04 feet to the Long 10 Island Railroad M.T.A.; 11 RUNNING THENCE along the Long Island Railroad M.T.A., North 80 degrees 12 17 minutes 40 seconds East, 510.12 feet; 13 RUNNING THENCE the following two courses and distances along land now 14 or formerly of Suffolk County Water Authority: 15 (1) South 14 degrees 06 minutes 20 seconds East, 77.43 feet; 16 (2) South 9 degrees 28 minutes 20 seconds East 427.77 feet; 17 RUNNING THENCE South 80 degrees 31 minutes 20 seconds West, 195.92 18 feet to the easterly side of Pantigo Place, the point or place of begin- 19 ning. Total of 4.5 acres. 20 The subject premises are also known as Lot 3 on Map of Pospisil Asso- 21 ciates, filed in the Suffolk County Clerk's Office on September 28, 1988 22 under File No. 8623. 23 § 4. In the event that the town of East Hampton received any funding 24 support or assistance from the federal government for the purchase, 25 maintenance or improvement of the parklands set forth in section three 26 of this act, the discontinuance and alienation of such parkland author- 27 ized by the provisions of this act shall not occur until the town of 28 East Hampton has complied with any federal requirements pertaining to 29 the alienation or conversion of parklands, including satisfying the 30 secretary of the interior that the alienation or conversion complies 31 with all conditions which the secretary of the interior deems necessary 32 to assure the substitution of other lands shall be equivalent in fair 33 market value and usefulness to the lands being alienated or converted. 34 § 5. This act shall take effect immediately.
