KLEIN, AVELLA, CARLUCCI, SAVINO, VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families -- recommitted to the Committee on Children and Families in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the social services law, in relation to the establish- ment of a performance summary card for child care services in a city having a population of one million or more The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The social services law is amended by adding a new section 2 390-j to read as follows: 3 § 390-j. Performance summary card in a city having a population of one 4 million or more. 1. Definitions. For the purposes of this section, the 5 following terms shall have the following meanings: 6 (a) "Child care service" shall mean any person who provides child day 7 care in a city having a population of one million or more that is 8 required to obtain a permit to operate pursuant to the health code of 9 such city. 10 (b) "Performance summary card" shall mean an individualized placard 11 that summarizes the health and safety inspections of a child care 12 service to reflect its compliance with applicable laws. The performance 13 summary card shall summarize recent inspection violations and suspen- 14 sions as required by rules promulgated by the department issuing such 15 card. A performance summary card may also include additional information 16 such as the capacity of the child care service, the length of time for 17 which such child care service has operated, a comparison of the child 18 care service to other child care services in the same social services 19 district, and other information required by such department's rules. The department of health and mental 2 hygiene of a city having a population of one million or more shall issue 3 a performance summary card to each child care service that is required 4 to be permitted by the board of health of such city. Such performance 5 card shall be updated and reissued by such department at least once 6 every twelve months. The child care service shall conspicuously post its 7 most recently issued performance summary card at or near its entrance in 8 accordance with rules promulgated by such department. 9 § 2. This act shall take effect one year after it shall have become a 10 law; provided, however, that effective immediately any rules and regu- 11 lations necessary to implement the provisions of this act on its effec- 12 tive date are authorized to and may be completed on or before such date.
