        Introduced  by Sen. GRIFFO -- (at request of the New York Power Authori-
          ty) -- read twice and ordered printed, and when printed to be  commit-
          ted to the Committee on Energy and Telecommunications
        AN ACT to amend the public authorities law, in relation to energy-relat-
          ed projects, programs and services of the power authority of the state
          of New York
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Paragraph (a) of subdivision 17  of  section  1005  of  the
     2  public  authorities  law, as amended by chapter 494 of the laws of 2011,
     3  is amended to read as follows:
     4    (a) As deemed feasible and  advisable  by  the  trustees,  to  finance
     5  [and],  design,  develop,  construct,  implement, provide and administer
     6  energy-related projects, programs and services for  any  public  entity,
     7  any  independent  not-for-profit  institution of higher education within
     8  the state, [and] any recipient  of  [the]  economic  development  power,
     9  expansion power, replacement power, preservation power, high load factor
    10  power,  municipal  distribution  agency  power, [power for jobs, and] or
    11  recharge New York power [programs  administered  by]  allocated  by  the
    12  authority,  and  any  party  located  within the state of New York under
    13  contract with the authority to purchase power from the authority  pursu-
    14  ant  to  this title or any other law. In establishing and providing high
    15  performance and sustainable building programs and services authorized by
    16  this subdivision, the authority  is  authorized  to  consult  standards,
    17  guidelines,  rating  systems,  and/or criteria established or adopted by
    18  other organizations, including but not  limited  to  the  United  States
    19  green  building council under its leadership in energy and environmental
    20  design (LEED) programs, the green  building  initiative's  green  globes
    21  rating system, and the American National Standards Institute. The source
    22  of any financing and/or loans provided by the authority for the purposes
    23  of  this  subdivision  may  be  the proceeds of notes issued pursuant to

     1  section one thousand nine-a of this title, the proceeds of bonds  issued
     2  pursuant  to section one thousand ten of this title, or any other avail-
     3  able authority funds.
     4    § 2. Subparagraph 2 of paragraph (b) of subdivision 17 of section 1005
     5  of  the  public  authorities law, as added by chapter 477 of the laws of
     6  2009 and such subdivision as renumbered by section  16  of  part  CC  of
     7  chapter 60 of the laws of 2011, is amended to read as follows:
     8    (2)  "Energy-related  projects,  programs  and  services" means energy
     9  management, distribution, or control projects and services, energy effi-
    10  ciency projects and  services,  clean  energy  technology  projects  and
    11  services,  and  high  performance  and sustainable building programs and
    12  services, and the construction, installation and/or operation of facili-
    13  ties or equipment done in connection with any such projects, programs or
    14  services.
    15    § 3. This act shall take effect immediately.
