MONTGOMERY -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to membership on the state procurement council THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph a of subdivision 1 of section 161 of the state 2 finance law, as amended by chapter 175 of the laws of 2010, is amended 3 to read as follows: 4 a. The state procurement council shall continuously strive to improve 5 the state's procurement process. Such council shall consist of [twenty] 6 TWENTY-ONE members, including the commissioner, the state comptroller, 7 the director of the budget, the chief diversity officer and the commis- 8 sioner of economic development, or their respective designees; seven 9 members who shall be the heads of other large and small state agencies 10 chosen by the governor, or their respective designees; ONE MEMBER, 11 APPOINTED BY THE GOVERNOR, WHO SHALL BE A MEMBER OF A NOT-FOR-PROFIT, 12 NEW YORK BASED ORGANIZATION REPRESENTING AGRICULTURAL INTERESTS OF THE 13 STATE; and eight at large members appointed as follows: three appointed 14 by the temporary president of the senate, one of whom shall be a repre- 15 sentative of local government and one of whom shall be a representative 16 of private business; three appointed by the speaker of the assembly, one 17 of whom shall be a representative of local government and one of whom 18 shall be a representative of private business; one appointed by the 19 minority leader of the senate; and, one appointed by the minority leader 20 of the assembly; and two non-voting observers appointed as follows: one 21 appointed by the temporary president of the senate and one appointed by 22 the speaker of the assembly. The non-voting observers shall be provided, 23 contemporaneously, all documentation and materials distributed to 24 members. The council shall be chaired by the commissioner and shall meet 25 at least quarterly. 26 S 2. This act shall take effect immediately.
