STATE OF NEW YORK ________________________________________________________________________ 4401 2023-2024 Regular Sessions IN SENATE February 8, 2023 ___________ Introduced by Sen. WEBB -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to physician course- work or training in nutrition The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 264 to read as follows: 3 § 264. Provision of information related to coursework or training in 4 nutrition. 1. The department shall develop, maintain, and distribute to 5 practicing and licensed physicians in the state a resource library 6 related to continuing medical education and training opportunities 7 regarding nutrition, which shall include but not be limited to plant- 8 based nutrition and other clinically proven methods for the prevention, 9 reversal, and treatment of diet-related illnesses. The resource library 10 shall include continuing education resources regarding racial dispari- 11 ties in outcomes for diet-related diseases. 12 2. The resource library shall be made publicly available on the 13 department's website and updated and redistributed annually via email. 14 3. The department shall consult with organizations representative of 15 professions, institutions, and those with expertise in nutrition and the 16 prevention, reversal, and treatment of diet-related illnesses to compile 17 these resources. Coursework or training funded directly or indirectly by 18 commercial food production entities, or their trade organizations shall 19 not be included in the distributed list of coursework. 20 4. The department shall conduct a follow-up survey two, four, and six 21 years after the first distribution of the resource library to ascertain 22 what proportion of physicians in the state voluntarily enrolled in 23 nutrition continuing medical education courses and trainings to deter- 24 mine best practices for delivering information about the availability of 25 such courses and trainings. The report shall be delivered to the legis- 26 lature and made available to the public. 27 § 2. This act shall take effect immediately.
