        Introduced  by  Sen.  YOUNG  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Transportation
        AN ACT to amend the vehicle and traffic law, in relation to the issuance
          of specialty plates for members of AMVETS
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1.  The  vehicle  and  traffic law is amended by adding a new
     2  section 404-y to read as follows:
     3    § 404-y. Distinctive plates for AMVETS. 1. Any member  of  the  AMVETS
     4  residing  in  this  state shall, upon request, be issued a license plate
     5  bearing the term "American Veteran", "AMVET" or "AMVETS" as  decided  by
     6  the  commission.  Application for said license plate shall be filed with
     7  the commissioner in such form  and  detail  as  the  commissioner  shall
     8  prescribe.
     9    2.  The  distinctive  plate authorized by this section shall be issued
    10  upon proof, satisfactory to the commissioner, that the  applicant  is  a
    11  member of AMVETS.
    12    3. A distinctive plate issued pursuant to this section shall be issued
    13  in  the  same  manner as other number plates upon payment of the regular
    14  registration fee prescribed by section four  hundred  of  this  article,
    15  provided,  however,  that  an  additional one-time service charge of ten
    16  dollars shall be charged for such plate.
    17    4. For the purposes of this section, "AMVETS" shall mean the federally
    18  chartered corporation dedicated to  advocating  on  behalf  of  American
    19  veterans.
    20    §  2.  1. A distinctive plate established pursuant to section 404-y of
    21  the vehicle and traffic law as added by section one of  the  chapter  of
    22  the  laws of 2017 enacting this section shall only be designed, produced
    23  and issued upon the delivery to the department of a surety bond  in  the
    24  amount  of  six  thousand  dollars,  which shall be executed by a surety
    25  company authorized by the department of financial services  to  transact

     1  business  in  this  state.  Provided,  however, that if the commissioner
     2  shall have received prior to the plate design, production  and  issuance
     3  of  at least two hundred orders for such distinctive plate together with
     4  the  additional  annual  service  charge  applicable to each such order,
     5  which shall be non-refundable, no such surety bond  shall  be  required.
     6  All  such  service charges shall be deposited pursuant to the provisions
     7  of section four hundred four-oo of article fourteen of the  vehicle  and
     8  traffic  law  to the credit of the department of motor vehicles distinc-
     9  tive plate development fund established by section ninety-five-g of  the
    10  state  finance  law and shall be used for the design, production, adver-
    11  tising and distribution of distinctive license plates in accordance with
    12  such section ninety-five-g.
    13    2. If, upon the expiration of two years following the date upon  which
    14  distinctive  plates  in  the  series  are  first  available for sale two
    15  hundred or more sets of such plates are sold, a bond delivered  pursuant
    16  to this section shall be discontinued. If fewer than two hundred sets of
    17  such  plates  are sold by such time, the department shall be entitled to
    18  recover against the bond in an amount proportionate to such shortfall.
    19    § 3. This act shall take effect on the one hundred eightieth day after
    20  it shall have become a law; provided, however, that section two of  this
    21  act  shall  take  effect  immediately;  provided  further, however, that
    22  effective immediately, the addition, amendment and/or repeal of any rule
    23  or regulation necessary for the implementation of this act on its effec-
    24  tive date is authorized and directed to be  made  and  completed  on  or
    25  before such effective date.
