       AN ACT to authorize the city of New  York  to  discontinue  use  of  and
         convey certain park land
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subject to the provisions of this act, the city of New York
    2  is authorized to discontinue use as park land  and  to  convey,  in  fee
    3  simple,  the  land  described in section three of this act. Such land is
    4  authorized to be conveyed to the  Saint  Michael's  Cemetery  upon  such
    5  terms  and  conditions as the city council of the city of New York shall
    6  determine to be fair and reasonable.
    7    S 2. The authorization provided in section one of this  act  shall  be
    8  subject  to  the  requirement  that  the  city of New York shall use any
    9  proceeds and/or land received in exchange for the conveyance  authorized
   10  by  this  act  to acquire land, to be dedicated for park purposes, in an
   11  amount equal to or greater than the fair market value of the land  being
   12  conveyed  pursuant  to  this act and/or used for capital improvements to
   13  existing park and recreational facilities.
   14    S 3. The land authorized to be discontinued as park land and  conveyed
   15  is as follows:
   16    ALL  that  certain  plot,  piece  or parcel of land situate, lying and
   17  being in the Borough and County of Queens, City and State of  New  York,
   18  bounded and described as follows:
   19    BEGINNING at the corner formed by the intersection of the northwester-
   20  ly  side  of 30th Avenue (80 feet wide) with the westerly side of Brook-
   21  lyn-Queens Expressway East (also known as Boody Street) (134 feet wide)
   22    RUNNING THENCE northerly, the  following  nine  courses  and  distance
   23  along the westerly side of Brooklyn-Queens Expressway East;
   24    1.  THENCE  North 01 degrees 17 minutes 43.9 seconds West, 730.91 feet
   25  to a point of curvature;

    1    2. THENCE northeasterly, along a curve bearing to the right  having  a
    2  radius  of  500  feet, an arc length of 94.51 feet to a point of reverse
    3  curvature;
    4    3.  THENCE  northeasterly  and northerly, along a curve bearing to the
    5  left having a radius of 630.991 feet, an arc length of 105.76 feet to  a
    6  point of tangency;
    7    4.  THENCE  North 00 degrees 04 minutes 05.3 seconds West, 335.51 feet
    8  to a point of curvature;
    9    5. THENCE northeasterly, along a curve bearing to the right  having  a
   10  radius  of  816.101  feet,  an  arc  length of 275.78 feet to a point of
   11  tangency;
   12    6. THENCE North 19 degrees 17 minutes 37.0 seconds East, 93.40 feet to
   13  a point of curvature;
   14    7. THENCE northerly and northwesterly, along a curve  bearing  to  the
   15  left  having a radius of 569.635 feet, an arc length of 337.96 feet to a
   16  point of tangency;
   17    8. THENCE North 14 degrees 41 minutes 57.9 seconds West,  556.50  feet
   18  to a point of curvature;
   19    9.  THENCE  northwesterly,  along a curve bearing to the left having a
   20  radius of 30.00 feet, an arc length of 22.63 feet to the southerly  side
   21  of  Grand  Central  Parkway  Extension  (also known as Astoria Boulevard
   22  South);
   23    RUNNING THENCE South 73 degrees 53 minutes 24.9  seconds  West,  along
   24  the  southerly  side of Grand Central Parkway Extension, 15.99 feet to a
   25  point;
   26    RUNNING THENCE South 11 degrees 05 minutes 28.4 seconds  East,  301.87
   27  feet to a point;
   28    RUNNING  THENCE  South 11 degrees 45 minutes 55.0 seconds East, 363.31
   29  feet to a point;
   30    RUNNING THENCE South 08 degrees 45 minutes 15.0  seconds  East,  25.00
   31  feet to a point;
   32    RUNNING  THENCE  South  04  degrees  20 minutes East, 206.73 feet to a

   39  feet to the northwesterly side of 30th Avenue;
   40    RUNNING  THENCE  North  53 degrees 05 minutes 15.0 seconds East, 57.40
   41  feet to the corner formed by the intersection of the northwesterly  side
   42  of  30th  Avenue  with  the  westerly side of Brooklyn-Queens Expressway
   43  East, the point or place of BEGINNING.
   44    Consisting of 3.77 acres  .
   45    S 4. If the parkland that is the subject  of  this  act  has  received
   46  funding  pursuant  to  the federal land and water conservation fund, the
   47  discontinuance of parkland authorized by  the  provisions  of  this  act
   48  shall  not  occur  until  the municipality has complied with the federal
   49  requirements pertaining to the conversion of parklands, including satis-
   50  fying the secretary of the interior that the discontinuance will include
   51  all conditions which the secretary of the interior  deems  necessary  to
   52  assure  the  substitution  of  other  lands  shall be equivalent in fair
   53  market value and recreational usefulness to the lands  being  discontin-
   54  ued.
   55    S 5. This act shall take effect immediately.
