STATE OF NEW YORK ________________________________________________________________________ 3205 2021-2022 Regular Sessions IN SENATE January 28, 2021 ___________ Introduced by Sen. ORTT -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to a leave of absence for military spouses The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 202-i of the labor law is amended by adding a new 2 subdivision 5 to read as follows: 3 5. The spouse of a member of the armed forces of the United States, 4 national guard or reserves who has been deployed, shall be allowed up to 5 ten days unpaid leave by their employer. Such leave shall only be used 6 when such person's spouse is on leave from the armed forces of the 7 United States, national guard, or reserves after having been deployed 8 for a period of no less than one hundred twenty days. 9 § 2.
