        Introduced  by Sen. HARCKHAM -- read twice and ordered printed, and when
          printed to be committed to the Committee on Education

        AN ACT in relation to requiring school districts to provide  educational
          and support services to students with disabilities until such students
          turn twenty-two years of age

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Notwithstanding any provision of law, rule or regulation to
     2  the contrary, in  recognition  of  the  difficulties  distance  learning
     3  during the coronavirus  (COVID-19) pandemic poses to students with disa-
     4  bilities,  and the educational opportunities for students with disabili-
     5  ties that were lost or hampered, each New  York  school  district  shall
     6  provide  educational  and support services to students with disabilities
     7  in special education programs and to  pupils  who  are  qualified  hand-
     8  icapped persons as defined in the federal rehabilitation act of nineteen
     9  hundred seventy-three, as amended, in accordance with the student's most
    10  recent  Individualized  Education Program (IEP) until such student turns
    11  twenty-two years of age for the school years 2020-2021 and 2021-2022.
    12    § 2. This act shall take effect immediately and  shall  apply  to  the
    13  2020-2021 and 2021-2022 school years only.
