KAVANAGH -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee -- reported favorably from said commit- tee and committed to the Committee on Labor -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to notification of past and present businesses and their employees of potential eligibil- ity for the September eleventh victim compensation fund and the World Trade Center health program The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "9/11 2 notice act". 3 § 2. The general business law is amended by adding a new section 399- 4 rr to read as follows: 5 § 399-rr. September eleventh victim compensation fund and World Trade 6 Center health program notification. 1. Definitions. For the purposes 7 of this section, the following terms shall have the following meanings: 8 (a) the "eligible time period" and "notice area" shall be the same as 9 provided for in the September eleventh victim compensation fund pursuant 10 to 49 USC 40101 and World Trade Center health program pursuant to 42 USC 11 300mm. 12 (b) the "September eleventh victim compensation fund" shall be the 13 September eleventh victim compensation fund established under the Air 14 Transportation Safety and System Stabilization Act (49 USC 40101). 15 (c) the "World Trade Center health program" shall be the World Trade 16 Center health program established under 42 USC 300mm. 17 2. The department of economic development shall, in consultation with 18 the department of labor and any other appropriate state or municipal EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD01787-09-3S. 2946--B 2 1 entity, develop rules and regulations necessary to promote awareness and 2 notification to any past or present businesses and their employees which 3 operated within the New York city disaster area during the eligible time 4 period of their potential eligibility under the September eleventh 5 victim compensation fund and the World Trade Center health program. This 6 subdivision shall apply to both current and former employees. The 7 department of economic development shall determine the most appropriate 8 message and format that the state agencies may use to assist potentially 9 eligible employers and employees with such awareness or notification. 10 3. The department of economic development shall be authorized to 11 consult with the special master of the September eleventh victim compen- 12 sation fund and the program administrator of the World Trade Center 13 health program relating to matters including, but not limited to, 14 messaging and format to be used in the promotion of the September elev- 15 enth victim compensation fund and the World Trade Center health program 16 and if the messages should be tailored for the specific geographic areas 17 covered by the World Trade Center health program in a different manner 18 than those covered by both the World Trade Center health program and the 19 September eleventh victim compensation fund. 20 § 3. This act shall take effect on the two hundred seventieth day 21 after it shall have become a law.
