STATE OF NEW YORK ________________________________________________________________________ 10167 IN ASSEMBLY May 10, 2024 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Blumencranz) -- read once and referred to the Committee on Governmental Employees AN ACT to amend the civil service law, in relation to providing addi- tional credits to Nassau county law enforcement explorers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Short title. This act shall be known and may be cited as 2 the "Nassau future protectors act". 3 § 2. The civil service law is amended by adding a new article 6-A to 4 read as follows: 5 ARTICLE 6-A 6 SPECIAL RIGHTS FOR NASSAU COUNTY LAW ENFORCEMENT EXPLORERS 7 Section 89. Additional credit allowed for Nassau county law enforcement 8 explorers in competitive examinations; preference in 9 retention upon abolition of positions. 10 § 89. Additional credit allowed for Nassau county law enforcement 11 explorers in competitive examinations; preference in retention upon 12 abolition of positions. 1. Additional credits shall be allowed for 13 participants of the Nassau county law enforcement exploring program in 14 competitive examinations for original appointment. The Nassau county law 15 enforcement exploring program shall be defined as a youth police train- 16 ing program which provides youths between the ages of fourteen and twen- 17 ty with training and on the purpose, mission and objectives of the 18 Nassau county police department, public safety and law enforcement. 19 (a) On all eligible lists resulting from competitive examinations, the 20 names of eligible persons shall be entered in the order of respective 21 final earned ratings on examinations, with the name of the eligible 22 person with the highest final earned ratings at the head of such list, 23 provided, however, that for the purpose of determining final earned 24 ratings, Nassau county law enforcement explorers shall be entitled to 25 receive additional points in a competitive examination for original 26 appointment in Nassau county. An eligible person who served as a Nassau 27 county law enforcement explorer for a minimum of four years shall 28 receive an additional five points. LBD15354-01-4A. 10167 2 1 Nassau county law enforcement explorer for less than four years shall 2 receive an additional two points. 3 (b) Such additional credit shall be added to the final earned rating 4 of such Nassau county law enforcement explorer, after such explorer 5 qualified in the competitive examination and shall be granted only at 6 the time of establishment of the resulting eligible list. 7 2. Any candidate, believing themselves to be entitled to additional 8 credit in a competitive examination as provided in this section, may 9 make application for such additional credit at any time between the date 10 of application for examination and the date of the establishment of the 11 resulting eligible list. Such candidates shall be allowed a period of 12 not less than two months from the date of the filing of the application 13 for examination in which to establish by appropriate documentary proof 14 the eligibility to receive additional credit under this section. At any 15 time after two months have elapsed since the final date for filing 16 applications for a competitive examination for original appointment, the 17 eligible list resulting from such examination may be established, 18 notwithstanding the fact that a Nassau county law enforcement explorer 19 who has applied for additional credit has failed to establish the eligi- 20 bility to receive such additional credit. A candidate who fails to 21 establish, by appropriate documentary proof, the eligibility to receive 22 additional credit by the time an eligible list is established shall not 23 thereafter be granted additional credit on such eligible list. 24 3. (a) Except as otherwise provided in this subdivision, no person who 25 has received a permanent original appointment in the civil service of 26 Nassau county thereof from an eligible list on which such person was 27 allowed the additional credit granted by this section as a Nassau county 28 law enforcement explorer, shall thereafter be entitled to any additional 29 credit under this section. 30 (b) Where, at the time of establishment of an eligible list, the posi- 31 tion of a Nassau county law enforcement explorer on such list has not 32 been affected by the addition of credits granted under this section, the 33 appointment of such Nassau county law enforcement explorer from such 34 eligible list shall not be deemed to have been made from an eligible 35 list on which they were allowed the additional credit granted by this 36 section. 37 (c) If, at the time of appointment from an eligible list, a Nassau 38 county law enforcement explorer is in the same relative standing among 39 the eligible persons who are willing to accept appointment as if such 40 explorer had not been granted the additional credits as provided by this 41 section, the appointment from such eligible persons shall not be deemed 42 to have been made from an eligible list on which they were allowed such 43 additional credits. 44 (d) Where a Nassau county law enforcement explorer has been originally 45 appointed from an eligible list on which such explorer was allowed such 46 additional credit, but such appointment is thereafter terminated either 47 at the end of the probationary term or by resignation at or before the 48 end of the probationary term, such explorer shall not be deemed to have 49 been appointed, as the case may be, from an eligible list on which such 50 explorer is allowed additional credit, and such appointment shall not 51 affect such explorer's eligibility for additional credit in other exam- 52 inations. 53 4. An application for additional credit in a competitive examination 54 under this section may be withdrawn by the applicant at any time prior 55 to the establishment of the resulting eligible list. At any time during 56 the term of existence of an eligible list resulting from a competitiveA. 10167 3 1 examination in which a Nassau county law enforcement explorer has 2 received the additional credit granted by this section, such Nassau 3 county law enforcement explorer may elect, prior to permanent original 4 appointment, to relinquish the additional credit granted and accept the 5 lower position on such eligible list to which such explorer would other- 6 wise have been entitled; provided, however, that such election shall 7 thereafter be irrevocable. Such election shall be in writing and signed 8 by the Nassau county law enforcement explorer, and transmitted to the 9 department or the appropriate municipal civil service commission. 10 5. The department and each municipal commission shall establish and 11 maintain in its office a roster of all such Nassau county law enforce- 12 ment explorers appointed as a result of additional credits granted by 13 this section to positions under its jurisdiction. The appointment of a 14 Nassau county law enforcement explorer as a result of additional credits 15 shall be void if such Nassau county law enforcement explorer, prior to 16 such appointment, had been appointed as a result of additional credits 17 granted by this section. 18 § 3. This act shall take effect immediately.
