        AN ACT in relation to authorizing the village of Skaneateles, county  of
          Onondaga, to convey its interest in Austin Park to the town of Skanea-
          teles
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The village of  Skaneateles,  county  of  Onondaga,  acting
     2  through  its  village  board,  is  hereby  authorized to discontinue and
     3  alienate the lands known as "Austin Park" more particularly described in
     4  section two of this act, and to enter into  a  contract  to  convey  its
     5  interest in such parklands and facilities located thereon to the town of
     6  Skaneateles  for  continued park and recreational purposes. Any revenues
     7  received by the village of Skaneateles from the transfer of  such  park-
     8  lands  and  facilities  pursuant  to  this act shall be used for capital
     9  improvements of existing park and recreational facilities and/or for the
    10  acquisition of additional park and recreational facilities.
    11    § 2. The parklands authorized to be conveyed by the village of Skanea-
    12  teles pursuant to section one of this act shall be described as follows:
    13    LEGAL DESCRIPTION ALL THAT TRACT OR PARCEL  OF  LAND  situate  in  the
    14  Village  of Skaneateles, County of Onondaga and State of New York, being
    15  part of Block 4 and bounded and described as  follows:  BEGINNING  at  a
    16  point  on  the  centerline intersection of Jordan Street and East Austin
    17  Street; thence N16°11'19"W along said centerline of Jordan Street for  a
    18  distance of 403.14 feet to a point; thence N16°06'51"W, continuing along
    19  said  centerline  of  Jordan  Street  for a distance of 972.39 feet to a
    20  point; thence N87°03'56"E for a distance of 1780 feet to a point in  the
    21  centerline of State Street; thence S03°30'37"E along said centerline for
    22  a  distance  of  292.55  feet to a point; thence S09°44'03"W, continuing
    23  along said centerline of State Street for a distance of 609.15 feet to a
    24  point; thence N80°31'57"W for a distance of 68 feet to a  point  on  the
    25  westerly  boundary of a subdivision part of lot 4, Skaneateles, prepared
    26  by Ensign Cottrell and  filed  on  05-02-1937  in  the  Onondaga  County
    27  Clerk's  office  as  map  number  2455;  thence  S58°34'03"W, along said
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1  westerly boundary for a distance of  353.63  feet  to  a  point;  thence
     2  S62°38'03"W,  continuing  along said westerly boundary for a distance of
     3  233.59 feet to  a  point;  thence  S46°43'03"W,  continuing  along  said
     4  westerly  boundary  for  a  distance  of  186.40 feet to a point; thence
     5  S04°20'57"E, continuing along said westerly boundary for a  distance  of
     6  66  feet to a point in the centerline of said East Austin Street; thence
     7  S85°39'03"W, along said centerline for a distance of 605.09  feet  to  a
     8  point and place of beginning.  Containing 42.47± acres of land.
     9    Subject to all covenants, easements and restrictions of record.
    10    §  3.  The  parklands  to be transferred pursuant to this act, and all
    11  structures and facilities situated on such  parklands,  shall  be  main-
    12  tained,  owned, and operated by the town of Skaneateles once transferred
    13  to the town of Skaneateles.
    14    § 4. Where the availability  of  such  parklands  and  facilities  are
    15  limited,  the use of such parklands and facilities must be determined by
    16  an equitable method, which provides priority use to the  general  public
    17  based  on  a  reservation policy for free or a fee commensurate with the
    18  administrative costs necessary to maintain and operate such  a  facility
    19  or facilities.
    20    § 5. Subject to the provisions of this act and after the completion of
    21  the  transfer  of  such  parklands and facilities to the town of Skanea-
    22  teles, the town of Skaneateles, county of Onondaga, acting  through  its
    23  town  board, is hereby authorized to lease to a not-for-profit entity an
    24  unused portion of the building  known  as  the  "Austin  Pavilion",  and
    25  located  in  Austin Park, for the purpose of providing services to chil-
    26  dren deemed to be in the public's interest.
    27    § 6. Any revenues received by the town of  Skaneateles  in  connection
    28  with  the  lease shall be used for capital improvements of existing park
    29  and recreational facilities and/or for  the  acquisition  of  additional
    30  park and recreational facilities.
    31    §  7. Should the lease described in section five of this act be termi-
    32  nated for any reason, such property shall revert to the town of  Skanea-
    33  teles for public park and recreational purposes.
    34    § 8. This act shall take effect immediately.
