STATE OF NEW YORK ________________________________________________________________________ 10043--A IN ASSEMBLY May 6, 2016 ___________ Introduced by M. of A. FINCH -- read once and referred to the Committee on Local Governments -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to authorizing the village of Skaneateles, county of Onondaga, to convey its interest in Austin Park to the town of Skanea- teles The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. (a) The village of Skaneateles, county of Onondaga, acting 2 by and through its village board, is hereby authorized to discontinue 3 the use of "Austin Park" more particularly described in section two of 4 this act, and to convey such parklands, and all facilities located ther- 5 eon to the town of Skaneateles, upon such terms and conditions agreed 6 upon by the village of Skaneateles and the town of Skaneateles; provided 7 that the town of Skaneateles continue to use the property for park and 8 recreational purposes. (b) The town of Skaneateles shall continue to 9 provide access to the parklands and/or recreational facilities described 10 in section two of this act to all residents of the village of Skanea- 11 teles and shall not enact any fees which are higher for the residents of 12 the village of Skaneateles than those fees for the residents of the town 13 outside the village. (c) Any revenues received by the village of Skanea- 14 teles from the conveyance of parkland authorized by this act shall be 15 used for capital improvements to existing park and recreational facili- 16 ties and/or for the acquisition of additional parkland. 17 § 2. The parklands known as "Austin Park" authorized to be conveyed by 18 the village of Skaneateles pursuant to section one of this act shall be 19 described as follows: 20 LEGAL DESCRIPTION ALL THAT TRACT OR PARCEL OF LAND situate in the 21 Village of Skaneateles, County of Onondaga and State of New York, being 22 part of Block 4 and bounded and described as follows: BEGINNING at a 23 point on the centerline intersection of Jordan Street and East Austin 24 Street; thence N16°11'19"W along said centerline of Jordan Street for a 25 distance of 403.14 feet to a point; thence N16°06'51"W, continuing along 26 said centerline of Jordan Street for a distance of 972.39 feet to a EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD15280-02-6A. 10043--A 2 1 point; thence N87°03'56"E for a distance of 1780 feet to a point in the 2 centerline of State Street; thence S03°30'37"E along said centerline for 3 a distance of 292.55 feet to a point; thence S09°44'03"W, continuing 4 along said centerline of State Street for a distance of 609.15 feet to a 5 point; thence N80°31'57"W for a distance of 68 feet to a point on the 6 westerly boundary of a subdivision part of lot 4, Skaneateles, prepared 7 by Ensign Cottrell and filed on 05-02-1937 in the Onondaga County 8 Clerk's office as map number 2455; thence S58°34'03"W, along said 9 westerly boundary for a distance of 353.63 feet to a point; thence 10 S62°38'03"W, continuing along said westerly boundary for a distance of 11 233.59 feet to a point; thence S46°43'03"W, continuing along said 12 westerly boundary for a distance of 186.40 feet to a point; thence 13 S04°20'57"E, continuing along said westerly boundary for a distance of 14 66 feet to a point in the centerline of said East Austin Street; thence 15 S85°39'03"W, along said centerline for a distance of 605.09 feet to a 16 point and place of beginning. Containing 42.47± acres of land. 17 Subject to all covenants, easements and restrictions of record. 18 § 3. The parkland to be conveyed pursuant to section one of this act, 19 and all structures and facilities situated on such parkland, shall be 20 maintained, owned, and operated by the town of Skaneateles. 21 § 4. The use of such parkland and facilities shall be available to the 22 public. Where the availability of such facilities is limited, the use of 23 such facilities shall be determined by an equitable method which 24 provides priority use to the public based on a reservation policy for 25 free or nominal charge. 26 § 5. This act shall take effect immediately.
