       AN  ACT  to  amend  the  alcoholic  beverage control law, in relation to
         authorizing the retail sale of alcoholic beverages at  certain  stadi-
         ums, arenas or places of entertainment at eleven a.m. on Sunday
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 5 of section  106  of  the  alcoholic  beverage
    2  control law, as amended by chapter 83 of the laws of 1995, is amended to
    3  read as follows:
    4    5.  No  alcoholic  beverages  shall be sold, offered for sale or given
    5  away upon any premises licensed to sell alcoholic  beverages  at  retail
    6  for on-premises consumption, during the following hours:
    7    (a) Sunday, from four ante meridiem to twelve noon.
    8    (b)  On  any other day between four ante meridiem and eight ante meri-
    9  diem.
   10    Unless otherwise approved by the  authority  pursuant  to  subdivision
   11  eleven  of  section  seventeen  of this chapter, where any rule has been
   12  adopted in a county on or before April first, nineteen  hundred  ninety-
   13  five,  further  restricting  the  hours of sale for alcoholic beverages,
   14  such restricted hours shall be the hours, during which the sale of alco-
   15  holic beverages at retail  for  on-premises  consumption  shall  not  be
   16  permitted within such county.
   17    Nor  shall  any person be permitted to consume any alcoholic beverages
   18  upon any such premises later than one-half hour after the start  of  the
   19  prohibited hours of sale provided for in this section.
   20    NOTWITHSTANDING PARAGRAPH (A) OF THIS SUBDIVISION, NO ALCOHOLIC BEVER-
   21  AGES SHALL BE SOLD, OFFERED FOR SALE OR GIVEN AWAY AT ANY STADIUM, ARENA
   22  OR  PLACE OF ENTERTAINMENT HAVING A PERMANENT SEATING CAPACITY IN EXCESS
   23  OF TEN THOUSAND PERSONS, LICENSED TO SELL ALCOHOLIC BEVERAGES AT  RETAIL
   24  FOR ON-PREMISES CONSUMPTION ON SUNDAY, FROM FOUR ANTE MERIDIEM TO ELEVEN
   25  ANTE MERIDIEM.
   26    S 2. This act shall take effect immediately.
