STATE OF NEW YORK ________________________________________________________________________ 9662 IN ASSEMBLY January 30, 2018 ___________ Introduced by M. of A. O'DONNELL -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to parking spaces for handicapped persons The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (b) of subdivision 4 of section 502 of the vehi- 2 cle and traffic law, as amended by chapter 355 of the laws of 2017, is 3 amended and a new paragraph (i) is added to read as follows: 4 (b) Upon successful completion of the requirements set forth in para- 5 graph (a) of this subdivision which shall include an alcohol and drug 6 education component as described in paragraph (c) of this subdivision, a 7 "Road Rage" awareness component as described in paragraph (c-1) of this 8 subdivision and a "Work Zone Safety" awareness component as described in 9 paragraph (c-2) of this subdivision, [and] a "Motorcycle Safety" aware- 10 ness component as described in paragraph (c-3) of this subdivision, and 11 instruction in the laws relating to parking spaces for the handicapped 12 as described in paragraph (i) of this subdivision, the commissioner 13 shall cause the applicant to take a road test in a representative vehi- 14 cle of a type prescribed by the commissioner which shall be appropriate 15 to the type of license for which application is made, except that the 16 commissioner may waive the road test requirements for certain classes of 17 applicants. The commissioner shall have the power to establish a program 18 to allow persons other than employees of the department to conduct road 19 tests in representative vehicles when such tests are required for appli- 20 cants to obtain a class A, B or C license. If she chooses to do so, she 21 shall set forth her reasons in writing and conduct a public hearing on 22 the matter. She shall only establish such a program after holding the 23 public hearing. 24 (i) The commissioner shall provide in the pre-licensing course, set 25 forth in paragraph (b) of this subdivision a mandatory component in 26 education of the laws relating to handicapped accessible parking. 27 § 2. This act shall take effect on the one hundred twentieth day after 28 it shall have become a law. EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
