        AN  ACT to amend chapter 461 of the laws of 2017 relating to reciprocity
          of debarments imposed under the federal Davis-Bacon Act, and  relating
          to  a  work group to study and make recommendations to the legislature
          regarding the appropriate payment of supplements to construction work-
          ers, in relation to extending the effectiveness thereof

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Section 4 of chapter 461 of the laws of 2017, relating to
     2  reciprocity of debarments imposed under the federal Davis-Bacon Act, and
     3  relating to a work group to study and make recommendations to the legis-
     4  lature regarding the appropriate payment of supplements to  construction
     5  workers,  as  amended  by  chapter 79 of the laws of 2021, is amended to
     6  read as follows:
     7    § 4. This act shall take effect immediately; provided,  however,  that
     8  sections  one and two of this act shall take effect on the ninetieth day
     9  after it shall have become a law and shall apply  to  all  public  works
    10  bids  and  contracts solicited on or after such effective date and shall
    11  expire and be deemed repealed [six] nine years from such effective date;
    12  provided, that any contractor or  subcontractor  who  is  ineligible  to
    13  submit  a  bid  on  any  public work contract pursuant to this act shall
    14  remain ineligible as long as  the  name  of  the  person  or  entity  is
    15  published in the list of debarred contractors pursuant to 40 U.S.C. 3144
    16  notwithstanding such repeal of this act; provided, further however, this
    17  act  shall  not  apply  retroactively  to  previously issued or existing
    18  public works contracts,  with  the  state,  any  municipal  corporation,
    19  public benefit corporation or public body.
    20    § 2. This act shall take effect immediately.
