BRINDISI, LIFTON, PALMESANO, FRIEND, LUPARDO, CROUCH -- read once and referred to the Committee on Transportation -- recommitted to the Committee on Transportation in accordance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the transportation law, in relation to establishing the temporary advisory board on upstate transit funding; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The transportation law is amended by adding a new article 2 2-G to read as follows: 3 ARTICLE 2-G 4 TEMPORARY ADVISORY BOARD ON UPSTATE TRANSIT FUNDING 5 Section 74-a. Temporary advisory board on upstate transit funding. 6 74-b. Assistance of other agencies. 7 § 74-a. Temporary advisory board on upstate transit funding. 1. There 8 is hereby created in the department a board, to be known as the tempo- 9 rary advisory board on upstate transit funding. Such board shall study, 10 develop and make specific recommendations with respect to sustainable 11 state funding options for the growth and stability of the public trans- 12 portation systems operating assistance account, hereinafter referred to 13 as "PTSOA account", of the mass transportation operating assistance 14 fund. As part of such study, the board may provide an opportunity for 15 public comment including public hearings. 16 2. Such board shall consist of the commissioner and nine other members 17 to be appointed by the governor as follows: two upon the recommendation 18 of the temporary president of the senate, two upon the recommendation of 19 the speaker of the assembly, one upon the recommendation of the minority 20 leader of the senate, one upon the recommendation of the minority leader 21 of the assembly, and three without recommendation from any other person. LBD11497-02-6A. 8202--A 2 1 Of the nine members appointed by the governor, at least two shall be 2 representatives of local governments receiving PTSOA account funds, at 3 least two shall be representatives of public transportation authorities 4 receiving PTSOA account funds, at least two shall be representatives of 5 labor unions affiliated with public transportation systems receiving 6 PTSOA account funds, and at least two shall be representatives of riders 7 of public transportation systems receiving PTSOA account funds. 8 3. The commissioner shall serve as chair of the board, and personnel 9 of the department shall provide, from existing staff, services to the 10 board so that it may perform its duties. 11 4. Board members shall be appointed within thirty days after the 12 effective date of this article; provided, however, that after the expi- 13 ration of the thirty day period, the appointment of a majority of the 14 members shall constitute a quorum. Board members shall serve without 15 compensation. 16 5. The board shall prepare a report on or before December first, two 17 thousand sixteen on its findings and specific recommendations for 18 sustainable funding options for the growth and stability of the PTSOA 19 account. Such report shall be delivered by such date to the governor, 20 the temporary president of the senate, the speaker of the assembly, the 21 chair of the senate finance committee, the chair of the assembly ways 22 and means committee, the chair of the senate transportation committee, 23 the chair of the assembly transportation committee, the chair of the 24 senate corporations, authorities and commissions committee and the chair 25 of the assembly corporations, authorities and commissions committee. 26 § 74-b. Assistance of other agencies. To effectuate the purposes of 27 this article, the board may request and shall receive from any depart- 28 ment, division, board, bureau, commission or other agency of the state 29 or any state public authority such assistance, information and data as 30 will enable the board properly to conduct its study and make its recom- 31 mendations. 32 § 2. This act shall take effect immediately and shall expire and be 33 deemed repealed on the one hundred twentieth day after the temporary 34 advisory board on upstate transit funding has submitted its completed 35 report as required by section one of this act, provided that the commis- 36 sioner of transportation of the state of New York shall notify the 37 legislative bill drafting commission upon the occurrence of the 38 submission of the completed report as required by section one of this 39 act in order that the commission may maintain an accurate and timely 40 effective data base of the official text of the laws of the state of New 41 York in furtherance of effectuating the provisions of section 44 of the 42 legislative law and section 70-b of the public officers law.
