       AN ACT to amend the environmental conservation law, in relation  to  the
         powers  of the commissioner of the department of environmental conser-
         vation
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  4  of  section  3-0301  of the environmental
    2  conservation law, as added by chapter  719  of  the  laws  of  1981,  is
    3  amended to read as follows:
    4    4. The commissioner shall:
    5    (A) cooperate with the commissioner of the state department of health,
    6  district  attorneys and the department of law in providing assistance in
    7  the investigation and prosecution of violations of article  twenty-seven
    8  of this chapter; AND
    9    (B)  CONSIDER  COMPLIANCE  WITH FEDERAL AND STATE LAWS, REGULATIONS OR
   10  PERMITS GOVERNING THE ENVIRONMENT WHEN RESOLVING A DISPUTE  BETWEEN  TWO
   11  OR MORE MUNICIPALITIES.
   12    S 2. This act shall take effect immediately.
