STATE OF NEW YORK ________________________________________________________________________ 7487 2019-2020 Regular Sessions IN ASSEMBLY May 7, 2019 ___________ Introduced by M. of A. GUNTHER -- read once and referred to the Commit- tee on Mental Health AN ACT to amend the mental hygiene law, in relation to rental and mort- gage payments of supportive housing for the mentally ill The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 41.38 of the mental hygiene law, as amended by 2 chapter 218 of the laws of 1988, is amended to read as follows: 3 § 41.38 Rental and mortgage payments of community residential facilities 4 for the mentally ill. 5 Notwithstanding any inconsistent provision of this article, the 6 commissioner may reimburse voluntary agencies for the reasonable cost of 7 rental of or the reasonable mortgage payment or the reasonable principal 8 and interest payment on a loan for the purpose of financing an ownership 9 interest in, and proprietary lease from, an organization formed for the 10 purpose of the cooperative ownership of real estate, together with other 11 necessary costs associated with rental or ownership of property, for a 12 community residence [or], a residential care center for adults, or 13 supportive housing under his or her jurisdiction less any income 14 received from a state or federal agency or third party insurer which is 15 specifically intended to offset the cost of rental of the facility or 16 housing a client at the facility or of the supportive housing, subject 17 to the availability of appropriations therefor and such commissioner's 18 certification of the reasonableness of the rental cost, mortgage 19 payment, principal and interest payment on a loan as provided in this 20 section or other necessary costs associated with rental or ownership of 21 property, with the approval of the director of the budget. 22 § 2.
