STATE OF NEW YORK ________________________________________________________________________ 7251 2021-2022 Regular Sessions IN ASSEMBLY April 29, 2021 ___________ Introduced by M. of A. BENEDETTO -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the hours of operation of a demonstration program imposing fines for failure of a vehicle operator to comply with posted maximum speed limits in a school speed zone in the city of New York The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 1 of subdivision (a) of section 1180-b of the 2 vehicle and traffic law, as amended by chapter 30 of the laws of 2019, 3 is amended to read as follows: 4 1. Notwithstanding any other provision of law, the city of New York is 5 hereby authorized to establish a demonstration program imposing monetary 6 liability on the owner of a vehicle for failure of an operator thereof 7 to comply with posted maximum speed limits in a school speed zone within 8 such city (i) when a school speed limit is in effect as provided in 9 paragraphs one and two of subdivision (c) of section eleven hundred 10 eighty of this article or (ii) when other speed limits are in effect as 11 provided in subdivision (b), (d), (f) or (g) of section eleven hundred 12 eighty of this article [weekdays between the hours of six o'clock A.M.13and ten o'clock P.M.]. Such demonstration program shall empower the 14 city of New York to install photo speed violation monitoring systems 15 within no more than seven hundred fifty school speed zones within such 16 city at any one time and to operate such systems within such zones (iii) 17 when a school speed limit is in effect as provided in paragraphs one and 18 two of subdivision (c) of section eleven hundred eighty of this article 19 or (iv) when other speed limits are in effect as provided in subdivision 20 (b), (d), (f) or (g) of section eleven hundred eighty of this article 21 [weekdays between the hours of six o'clock A.M. and ten o'clock P.M.]. 22 In selecting a school speed zone in which to install and operate a 23 photo speed violation monitoring system, the city of New York shall EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD06419-01-1A. 7251 2 1 consider criteria including, but not limited to, the speed data, crash 2 history, and the roadway geometry applicable to such school speed zone. 3 Such city shall prioritize the placement of photo speed violation moni- 4 toring systems in school speed zones based upon speed data or the crash 5 history of a school speed zone. A photo speed violation monitoring 6 system shall not be installed or operated on a controlled-access highway 7 exit ramp or within three hundred feet along a highway that continues 8 from the end of a controlled-access highway exit ramp. 9 § 2. This act shall take effect immediately; provided, however, that 10 the amendments to paragraph 1 of subdivision (a) of section 1180-b of 11 the vehicle and traffic law made by section one of this act shall not 12 affect the repeal of such section and shall be deemed repealed there- 13 with.
