STATE OF NEW YORK ________________________________________________________________________ 7070 2019-2020 Regular Sessions IN ASSEMBLY April 4, 2019 ___________ Introduced by M. of A. BURKE -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to enacting the "traffic ticket relief act" The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Short title. This act shall be known and may be cited as 2 the "traffic ticket relief act". 3 § 2. Section 241 of the vehicle and traffic law is amended by adding a 4 new subdivision 4 to read as follows: 5 4. For any fine imposed on a person by a hearing examiner pursuant to 6 this section, the hearing examiner may reduce the amount of such fine as 7 a result of such person's lack of ability to pay. The hearing examiner 8 may request any documentation he or she believes necessary to make such 9 a determination. The hearing examiner may also authorize the person 10 fined to pay such fine in installments to be determined by the hearing 11 examiner. 12 § 3. Section 227 of the vehicle and traffic law is amended by adding a 13 new subdivision 7 to read as follows: 14 7. For any fine imposed on a person by a hearing officer pursuant to 15 this section, the hearing officer may reduce the amount of such fine as 16 a result of such person's lack of ability to pay. The hearing officer 17 may request any documentation he or she believes necessary to make such 18 a determination. The hearing officer may also authorize the person fined 19 to pay such fine in installments to be determined by the hearing offi- 20 cer. 21 § 4.
