        AN  ACT  to  amend  the public housing law, in relation to water contam-
          ination and air quality testing in New  York  city  housing  authority
          buildings
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The public  housing  law  is  amended  by  adding  two  new
     2  sections 402-e and 402-f to read as follows:
     3    §  402-e. Water contamination and air quality testing. 1. The New York
     4  city housing authority shall provide for annual water testing to monitor
     5  for lead or copper contamination in each building under the jurisdiction
     6  of the authority. The authority shall transmit a copy of such results to
     7  the commissioner of health. For purposes  of  this  section,  tap  water
     8  shall  be  considered  contaminated  if  such  water exceeds the lead or
     9  copper action level based on first-draw tap samples as provided in rules
    10  and regulations of the department of health authorized under section two
    11  hundred one of the public health law.
    12    2. The authority, in conjunction with the commissioner of health shall
    13  be required to conduct annual indoor air quality testing to monitor  for
    14  air  quality  in  each building under the jurisdiction of the authority.
    15  The authority shall transmit a copy of such results to the  commissioner
    16  of  health. The authority shall provide notice to all tenants where such
    17  air quality test results exceed department of health indoor  air  guide-
    18  lines or the occupational safety and health administration.

     1    3.  The  authority  shall  be civilly liable for actual damages of any
     2  tenant, if it is determined that such tenant has suffered adverse health
     3  conditions caused by the indoor air quality or water contamination of  a
     4  building under the jurisdiction of the authority.
     5    §  402-f.  Falsifying  authority records notification. 1. The New York
     6  city housing authority shall provide information to all  employees  that
     7  any  employee of the authority who falsifies records, including, but not
     8  limited to: (a) providing  inaccurate  water  contamination  results  or
     9  indoor  air quality reports; (b) falsifying any signature; or (c) making
    10  a false entry in or falsely altering any record or other written instru-
    11  ment filed with the authority shall be guilty of tampering  with  public
    12  records  in  the  second  degree pursuant to section 175.20 of the penal
    13  law.
    14    2. The authority shall  refer  any  case  of  an  employee  falsifying
    15  records to local law enforcement.
    16    § 2. This act shall take effect immediately.
