        AN  ACT  to  amend  the mental hygiene law, in relation to requiring the
          sponsor of a proposed community residence to  provide  notice  to  the
          executive  officer of the municipality of the number of registered sex
          offenders who would be residing in such residence
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section  1. The opening paragraph of paragraph 1 of subdivision (c) of
     2  section 41.34 of the mental hygiene law, as amended by chapter  1024  of
     3  the laws of 1981, is amended to read as follows:
     4    When a site has been selected by the sponsoring agency, it shall noti-
     5  fy  the  chief  executive  officer  of  the  municipality in writing and
     6  include in such notice the specific address of the  site,  the  type  of
     7  community  residence,  the  number of residents, the number of residents
     8  who are sex offenders required to register pursuant to article six-C  of
     9  the  correction  law  and  the  community  support  requirements  of the
    10  program. Such notice shall also contain the most recently published data
    11  compiled pursuant to section four hundred [sixty-three] sixty-three-a of
    12  the social services law which can reasonably be expected to  permit  the
    13  municipality  to  evaluate  all such facilities affecting the nature and
    14  character of the area wherein such proposed facility is to  be  located.
    15  The  municipality shall have forty days after the receipt of such notice
    16  to:
    17    § 2. This act shall take effect immediately.
