       AN  ACT to amend the executive law, in relation to the qualifications of
         certain county probation officer directors
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (a) of subdivision 6 of section 257 of the execu-
    2  tive  law,  as  added  by chapter 883 of the laws of 1983, is amended to
    3  read as follows:
    4    (a) Notwithstanding subdivision one of this section, the  director  of
    5  probation  in  counties  with  a  population  of  more than [four] THREE
    6  hundred thousand, except counties wholly contained within a city,  shall
    7  be  in the non-competitive class of civil service and shall be appointed
    8  by the county executive with the approval of the local  governing  body.
    9  There  shall  be  one  deputy director of probation, who shall be in the
   10  non-competitive class of civil service. Such deputy shall  be  appointed
   11  by the director of probation.
   12    S 2. This act shall take effect immediately.
