       AN ACT to amend the general business law, in relation to the disposal of
         bedding
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The general business law is amended by adding a new section
    2  389-d to read as follows:
    3    S 389-D. DISPOSAL OF BEDDING.   1. EACH  PIECE  OF  BEDDING  SHALL  BE
    4  ENCLOSED  IN A PROTECTIVE CONTAINER PRIOR TO ITS REMOVAL FROM A PREMISES
    5  WHERE IT WAS USED AND DURING ITS DISPOSAL; PROVIDED, HOWEVER,  THAT  THE
    6  PROVISIONS  OF THIS SUBDIVISION SHALL NOT APPLY TO ANY MATTRESS WITHIN A
    7  CITY HAVING A POPULATION OF ONE MILLION OR MORE.
    8    2. AS USED IN THIS SECTION, "PROTECTIVE CONTAINER" MEANS  ANY  PROTEC-
    9  TIVE  DEVICE,  MATERIAL, OBJECT OR COVERING WHICH FULLY ENCASES OR WRAPS
   10  BEDDING.
   11    3. ANY VIOLATION OF THIS SECTION SHALL BE PUNISHABLE BY A CIVIL PENAL-
   12  TY OF ONE HUNDRED DOLLARS PAYABLE TO THE DEPARTMENT OF STATE.
   13    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   14  have become a law.
