MAISEL, ENGLEBRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to prohibiting the use of thermal paper receipts or cash receipt paper containing bisphenol-A THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Section 37-0503 of the environmental conservation law, as 2 added by chapter 280 of the laws of 2010, is amended to read as follows: 3 S 37-0503. Definitions. 4 As used in this title[,]: 5 1. "child care product" means all pacifiers and unfilled beverage 6 containers to be used by children under three years old for the consump- 7 tion of liquids including pacifiers, baby bottles, baby bottle liners 8 and cups, cup lids, straws and sippy cups. 9 2. "THERMAL RECEIPT PAPER" OR "CASH RECEIPT PAPER" MEANS ANY PAPER 10 THAT IS USED BY A COMMERCIAL ENTITY TO ISSUE A MECHANICALLY PRODUCED 11 RECORD OF A COMMERCIAL TRANSACTION. 12 S 2. The environmental conservation law is amended by adding a new 13 section 37-0508 to read as follows: 14 S 37-0508. THERMAL RECEIPT PAPER. 15 NO PERSON SHALL MANUFACTURE, SELL, OFFER FOR SALE OR DISTRIBUTE IN 16 THIS STATE ANY THERMAL RECEIPT PAPER OR CASH REGISTER PAPER THAT 17 CONTAINS BISPHENOL-A. 18 S 3. This act shall take effect October 1, 2015. Effective immediate- 19 ly, the addition, amendment and/or repeal of any rule or regulation 20 necessary for the implementation of this act on its effective date is 21 authorized to be made on or before such date.
